Terms and Conditions
Please read these Terms and Conditions ("Terms") carefully before using the SuperHR website or services. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Service.
1. Interpretation and Definitions

‣ Service: The website (www.superhrcanada.com) and any related services provided by SuperHR Canada.
‣ You: The individual or legal entity using the Service.
‣ Country: Alberta, Canada.
2. Acknowledgment
These Terms govern your use of the Service and form the agreement between you and SuperHR Canada. If you are using the Service on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.
If you have signed a separate Service Agreement with SuperHR Canada, the terms of that agreement will prevail in the event of any conflict with these Terms.
3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age.
4. Privacy and Confidentiality
Your use of the Service is also governed by our Privacy Policy.
For business clients with a signed Service Agreement, the confidentiality and data protection terms in that agreement will apply. For all other users, we will treat your personal information in accordance with our Privacy Policy.
5. No Legal Advice
The information and materials provided through the Service are for informational purposes only and do not constitute legal advice. SuperHR Canada does not provide legal advice or services. You should seek independent legal counsel for any legal matters or decisions.
6. Links to Other Websites
Our Service may contain links to third-party websites or services not owned or controlled by SuperHR Canada. We assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. We recommend you review their terms and privacy policies.
7. Termination
We may terminate or suspend your access to the Service immediately, without notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
8. Limitation of Liability
To the fullest extent permitted by applicable law, SuperHR Canada’s liability to you for any claim arising out of or relating to your use of the Service will not exceed the greater of (a) the amount you paid for the Service in the 12 months prior to the event giving rise to the claim, or (b) $100 CAD.
In no event will SuperHR Canada be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, even if advised of the possibility of such damages.
Nothing in these Terms limits your rights under the Alberta Consumer Protection Act, the Canadian Consumer Product Safety Act, or any other applicable consumer protection legislation.
If you have a signed Service Agreement with SuperHR Canada, the limitation of liability in that agreement will apply.
9. Indemnity
You agree to indemnify and hold harmless SuperHR Canada from any claims, damages, or expenses (including legal fees) arising from your misuse of the Service or your violation of these Terms, except where prohibited by law.
For business clients, the indemnity provisions in your Service Agreement will apply.
10. "AS IS" and "AS AVAILABLE" Disclaimer
Except as expressly provided by applicable law, the Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. SuperHR Canada does not warrant that the Service will meet your requirements, be uninterrupted, secure, or error-free.
11. Force Majeure
Neither party shall be liable for any failure to perform due to causes beyond their reasonable control, including natural disasters, war, government action, or internet outages. The affected party will notify the other as soon as possible and make reasonable efforts to resume performance.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any legal action or proceeding shall be brought in the courts of Alberta, and the parties submit to the non-exclusive jurisdiction of those courts.
13. Severability and Waiver
If any provision of these Terms is held to be unenforceable, such provision will be interpreted to accomplish its objectives to the greatest extent possible, and the remaining provisions will remain in full force and effect.
No waiver of any breach or default will constitute a waiver of any other or subsequent breach or default.
14. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days’ notice by email or by posting a notice on our website. Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
15. Entire Agreement
These Terms constitute the entire agreement between you and SuperHR Canada regarding use of the Service, except where a separate signed Service Agreement exists, in which case the Service Agreement will prevail in the event of any conflict.
